Terms of Service

These terms govern your use of ITM Scouting (the “Service”). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service. Questions can be sent to [email protected].

Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only if a parent or guardian has read and agreed to these terms and permits your use, and that parent or guardian is responsible for your activity and for any purchases. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

Your account

You are responsible for the activity on your account and for keeping your password secure. Provide accurate information when you register, and let us know promptly if you believe your account has been compromised. You may not share your account, use someone else’s account, or create an account on behalf of another person without permission.

Acceptable use

Use the Service lawfully and respectfully. Do not attempt to access accounts or data that are not yours, probe or disrupt the Service, scrape or harvest content at scale, reverse engineer the Service, upload malicious code, or use the Service to harass others or post unlawful content. We may suspend or remove content or accounts that violate these terms.

Your content

Rankings, tiers, notes, and other content you create remain yours. You grant ITM Scouting the limited license needed to store and display that content back to you in order to operate the Service. You are responsible for the content you create and for having the rights to it.

Copyright and takedown

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to [email protected] identifying the material and where it appears, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will remove or disable access to material as appropriate and may terminate the accounts of repeat infringers.

Subscriptions and billing

The Service offers a free tier and a paid Pro subscription. Paid subscriptions are billed in advance through our payment processor, Stripe, on a recurring basis (monthly or yearly, depending on the plan you choose) and renew automatically until canceled. You can cancel at any time from your account settings; cancellation stops future renewals and your Pro access continues until the end of the current billing period. Prices may change, and we will give notice of changes before they take effect for your next renewal.

Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. We do not store your full card details; payment information is handled by Stripe.

Third-party data

Player and statistical data shown in the Service is provided for informational and entertainment purposes and may contain errors, omissions, or delays. It is not guaranteed to be accurate, complete, or current, and should not be relied on for wagering or other decisions where accuracy matters.

No affiliation

ITM Scouting is an independent product and is not affiliated with, endorsed by, or sponsored by the National Football League, its teams, or any players. Team and player names are used for identification only.

United States only

The Service is intended for users in the United States. It is not directed to individuals in the European Union or United Kingdom, and we do not offer or target the Service to those regions. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, ITM Scouting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, gross negligence, or personal injury caused by our negligence. These limitations apply to the maximum extent permitted by applicable law.

Indemnification

You agree to indemnify and hold harmless ITM Scouting and its operators from any claims, losses, liabilities, and expenses, including reasonable legal fees, arising out of content you create or submit, your use of the Service, or your violation of these terms or of any law or third-party right.

Termination

You may stop using the Service and delete your account at any time from the Delete Account page in Settings. We may suspend or terminate access if you violate these terms or if we discontinue the Service. Provisions that by their nature should survive termination, such as content licenses, disclaimers, and limitations of liability, will survive.

Changes

These terms may be updated. Material changes will be communicated to registered users by email or in the Service, and the date above will be revised. Continued use after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The state and federal courts located in Washington have exclusive jurisdiction over any dispute relating to these terms or the Service, and you consent to venue there.

Other terms

If any provision of these terms is found unenforceable, the rest remain in effect. These terms are the entire agreement between you and ITM Scouting regarding the Service and supersede any prior agreements. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. We may provide notices to you by email or within the Service, and you may send legal notices to [email protected].
